Kaashy - Terms of Service

1. Introduction

Welcome to Kaashy! By accessing, downloading, installing, or using the Kaashy mobile application, website, or any related services (collectively, the "Service"), you ("User", "you", or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy.

                If you do not agree to these Terms, please do not use our Service. Continued use of the Service following any changes to these Terms will constitute your acceptance of such changes.
            

2. Eligibility

To use Kaashy, you must be at least 18 years old and possess the legal capacity to enter into a binding agreement.

If you are using Kaashy on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to these Terms.

Verification:

Kaashy may implement age verification processes where required by law, including requesting identification or using electronic verification services. We reserve the right to deny access if proper verification cannot be completed.

3. Account Registration

To access certain features, you must create an account by providing a valid mobile phone number or email address. Identity verification, such as submitting national identification or other official documents, may be required.

You agree to provide accurate, current, and complete information during registration and maintain its accuracy thereafter.

Multiple or false accounts:

The creation of multiple accounts without authorization or providing false information may result in the suspension or permanent termination of your account. You are solely responsible for safeguarding your login credentials and for any activities conducted through your account.

4. Use of the Service

Kaashy enables users to:

Swap fiat currencies,
Store funds in digital wallets,
Send and receive payments,
Pay for goods and services via linked financial accounts.

You agree to use the Service strictly for lawful purposes.

Prohibited Actions include:

Using bots, scripts, or automation to interact with Kaashy,
Reverse engineering, decompiling, or attempting to access the source code,
Exploiting or abusing system vulnerabilities.

Violations may lead to account suspension, legal action, and reporting to law enforcement authorities.

5. Fees and Refunds

Kaashy may charge fees for certain transactions, which will be disclosed before confirmation.

By proceeding with a transaction, you acknowledge and accept any applicable fees.

Refunds:

Refund requests must be submitted via customer support and will undergo review.
Kaashy may deny refunds in cases of completed transactions, user error, or violation of these Terms.
If a refund is approved, funds will be credited back to the original payment method within 7–14 business days.
Refunds for mistaken transfers will be handled on a case-by-case basis.

6. User Conduct

You agree to:

Abide by all applicable laws and regulations,
Refrain from engaging in fraud, money laundering, or the financing of terrorism,
Avoid misusing the Service in ways that could harm Kaashy, other users, or third parties.

Violation of these rules may result in:

Immediate account suspension or termination,
Freezing of associated funds,
Legal action and cooperation with law enforcement authorities.

7. Third-Party Services

Kaashy utilizes third-party service providers, such as financial institutions, payment gateways, identity verification services, and cloud storage platforms.

While we select our partners carefully, we are not liable for disruptions, downtime, inaccuracies, or losses caused by third-party systems.

Your interactions with any third-party service providers are governed by their respective terms and privacy policies.

8. Termination

We reserve the right to suspend, restrict, or terminate your account at any time if:

You breach these Terms,
Fraudulent, illegal, or suspicious activities are detected,
Required by law or regulatory authorities.

Upon Termination:

Funds may be frozen for investigation as required by legal or regulatory obligations.
You may appeal by contacting support@kaashy.com within 15 business days from notice of suspension or termination.
If eligible, any remaining balance, minus outstanding fees, may be returned after proper verification.

9. Limitation of Liability

To the fullest extent permitted by law:

Kaashy shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

                However, Kaashy's limitation of liability does not exclude damages arising from gross negligence, willful misconduct, or unauthorized transactions attributable to Kaashy.
            

We do not guarantee uninterrupted, secure, or error-free operation of the Service.

10. Changes to Terms

We may amend these Terms from time to time to reflect updates in our practices or for legal or regulatory reasons.

When material changes occur, we will notify you via email or through in-app notifications.

Continued use of the Service following such updates constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Somaliland.

Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Somaliland.

If you access the Service outside Somaliland, you are responsible for compliance with local laws.

                Notice: These Terms of Service are provided in English only. By using the Kaashy app or website, you agree to and accept the terms as written, regardless of your primary language.
